Bill Decreasing Blood Alcohol Limit for Boaters Signed into Law

As of July 26, when Governor Ruth Ann Minner signed House Bill 328 into law, the legal blood alcohol concentration for boaters in Delaware has been lowered from 0.10 to 0.08, making the limit the same as the BAC for those who drive automobiles.

The act, which amends the section of the Delaware Code covering the operation of a vessel or boat while under the influence of intoxicating liquor or drugs, also brings the First State’s limit in line with the federal standard. Standardizing the BAC for waterways and roadways is important because 95 percent of all boats are trailerable.
